  • @Bluerasberry: Brilliant image - Why are we not using it at DYK? Its a brilliant bit of illustration and a superb gift. If we are going to use it then it would be good if someone confirms that it is a good likeness as its a nice looking picture. Victuallers (talk) 20:00, 29 July 2015 (UTC)
Long enough, new enough, QPQ done. ALT0 short enough, sourced and the most interesting hook of the three. I couldn't see any neutrality or copyright issues. I agree, that that image is a superb image and have included it myself in this nomination. Good to go.--Launchballer 00:38, 30 July 2015 (UTC)
  • The image looks fine; my question is the copyright issue. Though Bluerasberry commissioned the image, I don't see any evidence on the license form that the creator has given up her copyright, and as Kodama Creative made the artwork, I'm not sure what would be required for this: a note to OTRS from Kodama releasing it to either Bluerasberry or the world? @Bluerasberry: So can we hold this until we know if a license is possible? It would need to be either an OTRS or the artist could put a cc by sa logo on her deviantart page I think. Victuallers Launchballer BlueMoonset This was routine work for hire and I have the copyright. I am the one who applied the free license to this work because I am the copyright holder. If requested, I can submit to OTRS a copy of the agreement in which the artist assigned the copyright of this work to me. The artist is knowledgeable about copyright, routinely provides commercial art and the copyright to companies as work for hire, and charged me a special fee explicitly for the transfer of copyright. Likewise, I chose this artist on the basis of their artistic merit and because they understood the implications of assigning copyright to me. I have never seen anyone send in an email to OTRS for a work for which they themselves claim copyright and uploaded but I know this is an odd case. Should I append an OTRS template to the file and send in my agreement? Thanks. Blue Rasberry (talk) 21:15, 30 July 2015 (UTC)
First. Thank you!!! I understand the moral position and I was in two minds. On the one hand I understand your argument however I have bought paintings but my understanding is that at least in the UK I don't have the copyright. I believe I would need explicit signed transfer of the copyright. If this was not true then surely most images would not run out 70 years after the artists death?? .... because most would have been sold. I think we need some advice but I suspect that we do need "written" evidence not because we don't trust you (and I do) but because copyright law requires it. I would in your case to just take your word for it, but I can see this would create a precedent that might be abused by another editr. Victuallers (talk) 21:37, 30 July 2015 (UTC)

I understand your wanting to follow protocol. I anticipated this and thought about signalling OTRS, but then I decide to wait and see what anyone else thought. You are correct that in buying art the copyright is not transferred. Still, artists may sell the copyright to their work if they choose to do so. The best way to transfer copyright is with a written agreement, which I have for this case.
I checked this person's website just now and they have changed the text which was there when I made the purchase. Previously they were saying that they transferred copyright for an extra fee - I can only guess that few people understood what that meant. Now they say that they are transferring rights to use and reproduce the work commercially - not the same thing, but that is probably what most people think copyright is. Anyway, I sent in relevant parts of our email conversation and agreement to OTRS, and put an OTRS ticket on the page. I expect that it is explicit enough to confirm the artist's intent to transfer copyright in exchange for money. Blue Rasberry (talk) 01:08, 31 July 2015 (UTC)

  • I opened a thread at User talk:Crisco 1492#Template:Did you know nominations/Jashodaben Narendrabhai Modi, and while Crisco doesn't have OTRS rights, he's pinged Moonriddengirl, and she'll be asking someone at OTRS with experience in images and work for hire to expedite this. Let's wait until we've heard back, now that we've gone this far. Since the idea is that we're hoping the image will be used on the main page, it's important to get the permissions straightened out first. BlueMoonset (talk) 00:00, 1 August 2015 (UTC)
  • The OTRS ticket has been processed, meaning that the image is free and properly licensed; Moonriddengirl posted the following at Crisco's talk page: Good to go, BlueMoonset, thanks to the kindness of User:Steven Zhang. Thanks to both Steven and Moonriddengirl for their efforts on this nomination's behalf. I'm restoring the original approval tick given by Launchballer in his review above, before I questioned the copyright status of the image. I do hope that the person who promotes the hook will make it a lead hook, since this image was specifically commissioned for Wikipedia use. BlueMoonset (talk) 03:55, 1 August 2015 (UTC)
