File permission problem with File:Commission on Audit (Commonwealth Avenue, Quezon City; 03-13-2021).jpg

edit

Thanks for uploading File:Commission on Audit (Commonwealth Avenue, Quezon City; 03-13-2021).jpg. I noticed that while you provided a valid copyright licensing tag, there is no proof that the creator of the file has agreed to release it under the given license.

If you are the copyright holder for this media entirely yourself but have previously published it elsewhere (especially online), please either

  • make a note permitting reuse under the CC-BY-SA or another acceptable free license (see this list) at the site of the original publication; or
  • Send an email from an address associated with the original publication to permissions-en@wikimedia.org, stating your ownership of the material and your intention to publish it under a free license. You can find a sample permission letter here. If you take this step, add {{permission pending}} to the file description page to prevent premature deletion.

If you did not create it entirely yourself, please ask the person who created the file to take one of the two steps listed above, or if the owner of the file has already given their permission to you via email, please forward that email to permissions-en@wikimedia.org.

If you believe the media meets the criteria at Wikipedia:Non-free content, use a tag such as {{non-free fair use}} or one of the other tags listed at Wikipedia:File copyright tags#Fair use, and add a rationale justifying the file's use on the article or articles where it is included. See Wikipedia:File copyright tags for the full list of copyright tags that you can use.

If you have uploaded other files, consider checking that you have provided evidence that their copyright owners have agreed to license their works under the tags you supplied, too. You can find a list of files you have created in your upload log. Files lacking evidence of permission may be deleted one week after they have been tagged, as described in section F11 of the criteria for speedy deletion. You may wish to read Wikipedia's image use policy. If you have any questions please ask them at the Media copyright questions page. Thank you. --Minorax«¦talk¦» 02:28, 21 August 2022 (UTC)Reply

Thank you for uploading File:Iglesia ni cristo sign (philippine arena, ciudad de victoria, nlex, bocaue, bulacan)(2014-10-19).jpg.

This image is a derivative work, containing an "image within an image". Examples of such images would include a photograph of a sculpture, a scan of a magazine cover, or a screenshot of a computer game or movie. In each of these cases, the rights of the creator of the original image must be considered, as well as those of the creator of the derivative work.

While the image description page states the source and copyright status of the derivative work, it only names the creator of the original work without specifying the status of their copyright over the work.

Wikipedia takes copyright very seriously. It may be deleted soon, unless we can determine the license and the source of the original image. If you know this information, then you can add a copyright tag to the image description page.

If you have uploaded other derivative works, consider checking that you have specified their license and tagged them, too. You can find a list of files you have created in your upload log.

If you have any questions, please feel free to ask them at the media copyright questions page. If the file is already gone, you can still make a request for undeletion and ask for a chance to fix the problem. Thanks again for your cooperation. — Ирука13 13:51, 9 August 2023 (UTC)Reply

All images of structures owned by the government of the Philippines must not subject to removal for grounds of intellectual property, unless for security reasons (i.e. military camps). Public funds are also being used in maintaining those structures. Patrickroque01 (talk) 06:43, 6 September 2023 (UTC)Reply

The publicly-accessible park may be owned by the local government of Tacloban City in the Philippines, and FoP rules should not apply. The park is also outside the scope of Data Privacy Act of 2012 or Republic Act 10173 as it depicts an architectural work. There were also no security apprehension of 'no photography" policy when the image was taken. Patrickroque01 (talk) 03:42, 1 September 2023 (UTC)Reply

The park is owned by the government, and it's management is publicly-funded, which means the image should not be removed. What you're doing is a form of censorship. Patrickroque01 (talk) 17:47, 1 September 2023 (UTC)Reply

The municipal building and its facing park in the image are BOTH owned by the government of the Philippines and the maintenance is publicly-funded. This means such copyright ownership doesn't apply as these are public properties, unlike the privately-owned Ayala Avenue which imay subject to restrictive camera policy. Image Copyright problem

Thanks for uploading File:Zamboanga Cathedral (La Purisima, Zamboanga City; 10-06-2023).jpg.

While the description page states who made this derivative work, it currently doesn't specify who created the original work, so the overall copyright status is unclear. If you did not create the original work contained within this image, you will need to specify

  1. the creator of the original work
  2. the copyright status of the original work, usually indicated by adding a licensing tag. If you believe the media meets the criteria at Wikipedia:Non-free content, use a tag such as {{non-free fair use}} or one of the other tags listed at Wikipedia:Image copyright tags#Fair use. See Wikipedia:Image copyright tags for the full list of copyright tags that you can use.

If you have uploaded other derivative works, consider checking that you have specified their source and tagged them, too. You can find a list of files you have created in your upload log. Unsourced and untagged images may be deleted one week after they have been tagged, as described in section F4 of the criteria for speedy deletion. If the image is copyrighted under a non-free license (per Wikipedia:Fair use) then the image will be deleted 48 hours after 18:02, 1 August 2024 (UTC). If the file is already gone, you can still make a request for undeletion and ask for a chance to fix the problem. If you have any questions please ask them at the Media copyright questions page. Thank you. Raymondsiyluy05 (talk) 18:02, 1 August 2024 (UTC)Reply

This is a landmark of a permanent worship building that's visible in public view. The image was also taken using my own mirrorless camera. Kindly check the metadata embedded on the image whch proves it's my own capture, although the "Author" and 'Copyright Tag" on my camera is always disabled. Patrickroque01 (talk) 04:15, 2 August 2024 (UTC)Reply
Iside from checking the camera metadata carefully, I would also like to tell to please consult the property owners or management first before sending any deletion requests. Although this main cathedral of Zamboanga City is considered a private property, it's better to see with their either media relations office or security office to raise this derivative work matter, unless have already forwarded this on the church management and they responded. Thank you. Patrickroque01 (talk) 07:04, 2 August 2024 (UTC)Reply
@Raymondsiyluy05 have you seen {{FoP-USonly}}? A 2012 consensus holds that English Wikipedia does not need to follow the copyright laws of all other countries; only U.S. law matters in accordance to lex loci protectionis principle. The United States does provide Freedom of Panorama but for architecture only. Applying the choice of law principle, enwiki is not required to follow the laws of the Philippines, and can freely host copyrighted buildings from the Philippines courtesy of slightly-lenient U.S. copyright law (not the restrictive Philippine copyright law). This image may be infringing to the cathedral architect/designer's copyright as commercial CC license is used, but this "infringement" is allowed under U.S. law. JWilz12345 (Talk|Contrib's.) 12:18, 2 August 2024 (UTC)Reply
My apologies, I did not see this. Thank you for pointing it out. Raymondsiyluy05 (talk) 12:24, 2 August 2024 (UTC)Reply
@Raymondsiyluy05 no worries. Personally, I desire for FoP to be introduced here ASAP, so that WikiCommons can now host hundreds of Philippine buildings and monuments that are still under their designers' copyrights, including this church as well as Quezon Memorial Shrine, Malacañan Palace, Lion's Head (Benguet), Leyte Landing Memorial, and Sultan Haji Hassanal Bolkiah Mosque. But unfortunately, the three House Bills and one Senate Bill containing the FoP clause do not receive much attention. Much attention goes to the bills that aim to block sites and take down online platforms that promote copyright infringements, piracy, and counterfeiting; see meta:Pilipinas Panorama Community/Freedom of Panorama/Progress#19th Congress for more info.
