Appellate Committee ruling

edit

Is it not worth mentioning the statement released in response to the appellant's question, "In what circumstances, if any, is a judge entitled to direct a jury to return a verdict of guilty?" - 'The Crown contests that view, while acknowledging that the circumstances in which such a direction may be given are rare and exceptional. Such circumstances, it is said, exist where the burden of raising a defence rests on the defendant, and he has failed to discharge the burden upon him; or when the facts are agreed at trial, there is nothing calling for adjudication and there is no basis on which the defendant can properly avoid conviction on the uncontested facts.' - ref: http://www.publications.parliament.uk/pa/ld200405/ldjudgmt/jd050210/wang-1.htm Reichsfürst (talk) 17:03, 16 June 2011 (UTC)Reply

That view is dealt with in the summary of the judgment of the Court of Appeal. ISTB351 (talk) 00:53, 30 June 2011 (UTC)Reply
