List of people who have exhausted their appeals
editWORK IN PROGRESS, MORE TO COME! PLEASE DON'T REMOVE.
An inmate is considered to have exhausted their appeals if their sentence has fully withstood the appellate process; this involves either the individual's conviction and death sentence withstanding each stage of the appellate process or them waiving a part of the appellate process if a court has found them competent to do so. The following is a list of the stages in the appellate process that must be completed before the state can move forward with the inmate's execution:[4]
- The Direct Appeal
- State Post-Conviction Review
- Federal Habeas Corpus
Of those who have exhausted their appeals, some are immediately eligible to be executed but some are not. Some of the reasons that someone may not be immediately eligible for execution is a moratorium on executions in their state, a judicial stay of execution in their specific case, or their present incompetency to be executed.
