- It is used for a non-commercial and educational purpose.
- It is representative of Grover Whalen in one of his more important positions.
- There is no public domain photo available of Jimmy Dorsey. He became famous well after 1923 and he died in 1962 (and so it is not possible to take a photo of him).
- It should not affect the commercial viability of the copyright.
