A free image could not be created to replace it without itself being a derivative work. Also note that Shining Path does not claim property rights on its work, and indeed is against the very idea of rights as well as property. Further note that Shining Path cannot claim damages or property rights in US courts as its assets are frozen due to its listing on the Office of Foreign Assets Control's list of Specially Designated Global Terrorists, implemented under the International Emergency Economic Powers Act.
