According to Section 35 of Copyright and Neighbouring Rights Act (Chapter 26:05), as enacted in 2004:
The copyright in an artistic work which is permanently situated in a street, square or other public place or in premises open to the public shall not be infringed by—
(a) the work being included in a graphic work, a photograph, an audio-visual work, a broadcast or a cable programme;
(b) the making or copies of the work, where the copies are greatly reduced in scale.
Note: Section 61(3) states that the author of the artistic work in copyright must be attributed if the image or video of it is used commercially.

Under the following conditions:
attribution – You must give appropriate credit, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use.
share alike – If you remix, transform, or build upon the material, you must distribute your contributions under the same or compatible license as the original.
