Rationale of fair use

edit

The image Image:The Whole of the Moon Waterboys single.jpg is being linked here; though the picture is originally copyright, I (Jkelly 23:45, 24 February 2006 (UTC)) feel it is covered by fair use because:

  1. No free or public domain images could possibly be located for this single.
  2. The image is of lower resolution than the original cover. Copies made from it will be of inferior quality, and could not be used as artwork on illegal CD copies of the single.
  3. The image does not limit the copyright owners' rights to distribute the single in any way.
  4. For an article about an album, the cover artwork is arguably one of the most important images that could be included. This is the artwork, intended by Ensign Records for wide distribution. As such, it has future historical significance, and is a more appropriate choice than any other image available. The single is discussed extensively in the article This Is the Sea, the album from which this single was released; and this copyrighted, official image is contrasted with other unofficial images.
  5. This image is used on various websites, so its use on Wikipedia does not make it significantly more accessible or visible than it already is. The cover is being used for informational purposes only, and its use is not believed to detract from the original album in any way.
